Terms of Service

These Terms of Service ("Terms") govern your use of the BuddyHelps AI phone answering service operated by 28 Corp. ("we," "us," or "our"). By subscribing to or using BuddyHelps, you agree to these Terms.
1. Service Description
BuddyHelps provides AI-powered phone answering services for plumbing businesses. When you subscribe, you receive:
- A dedicated phone number for call forwarding
- AI phone answering with natural conversation capabilities
- Call recording and transcription
- Instant SMS and email lead notifications
- Custom business greeting
- 24/7 availability
- Mobile application for iOS and Android (optional)
28 Corp. grants you a non-exclusive, non-transferable right to access and use the BuddyHelps service solely for your internal plumbing business operations.
2. Pricing and Billing
Subscription Fee: $197 CAD every 28 days
Billing Cycle: Your subscription is billed every 28 days (approximately 13 billing periods per year)
Automatic Renewal: Your subscription automatically renews at the end of each billing period until you cancel
Setup Fee: Currently waived for early customers. Standard setup fee is $350 CAD.
3. Money-Back Guarantee
First-time subscribers may cancel within 28 days of their initial payment for a full refund. To request a refund, contact us at cameron@buddyhelps.ca within this period. Refunds are processed within 10 business days. This guarantee applies only to your first billing period.
4. Cancellation
You may cancel your subscription at any time by emailing cameron@buddyhelps.ca. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial periods after the initial 28-day guarantee period. There are no cancellation fees or penalties.
5. Fair Use Policy
"Unlimited calls" means normal use consistent with a typical small plumbing business receiving customer inquiries. This includes calls from customers seeking appointments, emergency assistance, and pricing information.
Prohibited Uses
The following are not covered under unlimited calls:
- Operating a call center or answering service for multiple businesses
- Reselling or sharing the service with non-affiliated businesses
- Telemarketing, auto-dialing, or robocalling
- Use for purposes other than customer service for your plumbing business
- Any illegal, fraudulent, or abusive activity
Enforcement
If your usage significantly exceeds normal patterns compared to other customers, we may contact you about alternative arrangements, implement limitations, or terminate service. We reserve the right to modify this policy with 30 days' notice.
6. Your Responsibilities
As a BuddyHelps subscriber, you agree to:
- Provide accurate account and billing information
- Use the service only for lawful purposes
- Disclose to callers that calls may be answered by AI and recorded
- Comply with PIPEDA, PIPA, and all applicable privacy laws regarding caller data
- Respond to access requests from callers regarding their personal information
- Not use the service for any business other than plumbing services
7. AI Disclosure
BuddyHelps uses artificial intelligence to answer calls and conduct conversations with callers. While our AI is designed to be helpful and professional, it is not human. The AI does not provide plumbing advice, diagnoses, quotes, or scheduling commitments. All business decisions remain with you, the plumber.
8. Mobile Application License
If you download and use the BuddyHelps mobile application ("App"), the following additional terms apply:
- License Grant: We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices you own or control, solely for accessing BuddyHelps services.
- Restrictions: You may not copy, modify, distribute, sell, or lease any part of the App, nor reverse engineer or attempt to extract source code.
- Updates: We may release updates to the App. Some updates may be required for continued use of the service.
- Push Notifications: The App may send push notifications for incoming calls and other service updates. You can manage notification preferences in your device settings.
- Device Requirements: The App requires an active internet connection and a compatible device. We are not responsible for service limitations due to your device or network.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." 28 CORP. DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. WE DO NOT GUARANTEE THAT THE AI WILL ACCURATELY CAPTURE ALL INFORMATION OR THAT ALL CALLS WILL BE SUCCESSFULLY PROCESSED.
10. Limitation of Liability
(A) IN NO EVENT SHALL 28 CORP. BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST REVENUE, LOSS OF DATA, LOSS OF BUSINESS OPPORTUNITIES, OR BUSINESS INTERRUPTION, REGARDLESS OF THE THEORY OF LIABILITY.
(B) 28 CORP.'S TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THIS AGREEMENT SHALL NOT EXCEED THE GREATER OF: (I) THE FEES PAID BY YOU DURING THE TWELVE MONTHS PRECEDING THE CLAIM; OR (II) $1,000 CAD.
(C) NOTHING IN THESE TERMS LIMITS LIABILITY FOR: (I) DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE; (II) FRAUD OR FRAUDULENT MISREPRESENTATION; OR (III) ANY LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.
11. Indemnification
You agree to indemnify, defend, and hold harmless 28 Corp. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your use of the service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your handling of caller data.
12. Termination
We may suspend or terminate your access to BuddyHelps immediately if you breach these Terms, engage in prohibited uses, or fail to pay subscription fees. Upon termination, your right to use the service ends immediately. We may retain your data as required by law or for legitimate business purposes.
13. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes via email at least 30 days before they take effect. Your continued use of the service after changes take effect constitutes acceptance of the new Terms.
14. Third-Party App Store Terms
If you download the App from Apple's App Store or Google Play:
- These Terms are between you and 28 Corp. only, not with Apple Inc. or Google LLC.
- 28 Corp., not Apple or Google, is solely responsible for the App and its content.
- Apple and Google have no obligation to provide maintenance or support for the App.
- In the event of any failure of the App to conform to applicable warranties, you may notify Apple or Google for a refund of the purchase price (if any). Apple and Google have no other warranty obligation.
- Apple and Google are not responsible for addressing any claims relating to the App, including product liability claims, legal compliance, or intellectual property claims.
- Apple and Google and their subsidiaries are third-party beneficiaries of these Terms. Upon acceptance, Apple and Google will have the right to enforce these Terms against you as a third-party beneficiary.
15. Governing Law
This Agreement is governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles. The parties submit to the exclusive jurisdiction of the courts of Alberta for any disputes arising from or related to these Terms.
